Terms of service
These terms are the agreement between you and AL MANNAN GENERAL TRADING FZE-LLC, trading as Solaryxdev, Sharjah, United Arab Emirates ("we", "us"), for the RefBooth app and the refbooth.com service. Using RefBooth means you accept them. They are short on purpose.
1. What RefBooth is
RefBooth measures audio files you upload and returns a report: readings such as loudness, true peak, dynamics, stereo and spectral balance, each judged against a target that depends on the platform and genre you choose, with findings ranked by what to fix first. The report is information to help you make decisions about your own work. It is not a guarantee that any platform will accept, play or present your track in any particular way, and platforms change their own requirements without telling us.
2. Your account
You sign in with your email address and a one-time code. You are responsible for keeping access to that mailbox secure. You must be at least 16 years old. One person, one account.
3. Your content
You keep every right in the audio you upload. You give us only the permission we need to provide the service: to store the file, measure it, produce and store the report, and show it back to you. We claim no other rights, and we do not use your audio for anything else.
You must have the right to upload what you upload. Do not upload audio you do not own or have permission to analyse. We may remove content and close accounts that break this rule or the law, and we will tell you if we do unless the law prevents it.
A track you mark as a reference is for your own comparison: it is never shared through a link. If you believe audio on RefBooth infringes your rights, write to support@refbooth.com with the details; we remove infringing audio and close the accounts of repeat infringers. RefBooth's software, design and names belong to us or our licensors, and using the service gives you no right in them.
4. Acceptable use
Do not use RefBooth for anything unlawful or fraudulent, and do not upload malware or files built to harm the service. Do not attempt to gain access to accounts, data or systems that are not yours; do not probe, overload or interfere with the service; do not use automated means to create accounts or upload at a scale the service is not offered for. Each account has a storage limit, shown in the app.
5. Availability and changes
We aim to keep RefBooth available but do not promise uninterrupted service. We may change, add or withdraw features. If we ever withdraw the service entirely we will give you reasonable notice and a way to export your reports first.
6. Fees
Analysis is free, and stays free. Studio is a paid subscription, with its prices on the pricing page. Nothing is charged unless you complete a checkout, which shows the price, any tax and the renewal before you pay. Nothing you already have will be taken away without notice.
7. Subscriptions
Paid plans are subscriptions, billed monthly or yearly at the price shown to you before you pay. Prices are set per country, and the price that applies is the one for the country you are billed in. The checkout charges the price for the country chosen on our pricing page, which starts as the country your connection comes from and which you can change there before you pay; if the billing address you give at checkout is in a country with another price, or one where Studio cannot be bought, we may cancel the subscription and refund the charge in full. Prices are in euros in the European Economic Area, in pounds sterling in the United Kingdom, and in US dollars everywhere else, and the pricing page says before you pay whether a price includes tax or tax is added at checkout. Studio cannot be bought from a few countries under international sanctions; where it cannot, the pricing page says so in place of the price. A subscription renews automatically at that price for the same term until you cancel it. If we raise the price on a subscription you already hold, we will tell you by e-mail at least 30 days before the new price takes effect, and you may cancel before it does.
You may cancel at any time; how to cancel, what happens to your access afterwards, and the 14-day money-back guarantee on a first charge are all set out in the refund and cancellation policy, which forms part of these terms. You buy from us, AL MANNAN GENERAL TRADING FZE-LLC. Stripe processes the payment for us and never passes your full card number to us. Your invoice comes from us, by e-mail through Stripe, and shows any tax charged; where the law of the country you are billed in requires us to charge VAT, GST or sales tax, the checkout adds or includes it. A business can give its VAT or tax number at checkout, and it is printed on the invoice.
7a. Referrals
Your referral link is in the app. When someone who signed up through your link pays for Studio for the first time and that payment clears, you get one free month of Studio.
- One free month for each friend, and at most 12 in any 12 months.
- The friend must be someone other than you. A second account of yours, or another address of yours, earns nothing.
- If the friend's first payment is refunded within the 14-day money-back period of the refund and cancellation policy, the free month for it is void, and taken back if it was already given.
- If you pay for Studio, the free month is a credit of one month's Studio price against your next charge. If you do not, it is one month of Studio that ends on its own and never charges you.
- A free month has no cash value and cannot be exchanged or passed on. Unused months end with your account.
- If you share your link in public, say that you get a free month when someone pays.
- We can withhold a reward where we have good reason to suspect abuse, and will say why. We can change or end the programme; months already earned are honoured.
8. Ending the agreement
You can end it at any time by deleting your account in the app or at refbooth.com/delete-account; your data is removed as described in the privacy policy. We can end it, or pause a paid plan, if you break these terms, if a payment fails or is charged back, or if we have good reason to suspect fraud, and will say why.
9. Liability
The service is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, or for decisions you take on the basis of a report. Nothing in these terms limits liability that cannot be limited by law, including for death, personal injury, or fraud.
10. Privacy
How we handle your data is set out in the privacy policy, which forms part of these terms.
11. Governing law
These terms are governed by the laws of the Emirate of Sharjah and the federal laws of the United Arab Emirates, and disputes go to the courts there, unless the law where you live gives you protections that cannot be taken away by agreement, in which case those apply as well.
12. Legal representatives
Where the law requires it, this section will name our representative under Article 27 of the EU GDPR and the equivalent UK GDPR provision, as the contact point for EU and UK data subjects and regulators. No representative is appointed yet; this is a placeholder for that appointment, not a statement that one exists.
